Terms of Service — Hold the Sky: Peregrine
1. Agreement
These Terms of Service (“Terms”) are a contract between you and Clear Skies for access to and use of the Game and related services (the “Services”).
By downloading, installing, opening, or playing the Game—including guest play—you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Who may use the Game
- You must be at least 13 years old.
- If you are under the age of majority where you live, you represent that a parent or guardian has reviewed these Terms with you and agrees to them.
- You must be able to form a binding contract and must not be barred from using the Services under applicable law.
We use an age gate. We store only eligibility information and a coarse age band—not your full date of birth—as described in the Privacy Policy.
3. The Game (what it is — and is not)
Hold the Sky: Peregrine is an entertainment and awareness AR game. It overlays virtual scenarios (including virtual drones and intercept concepts) on the real sky using your device camera.
The Game is not:
- a real weapons system, military training qualification, or operational counter-drone product for end users;
- a substitute for emergency services, air-traffic control, or official guidance;
- permission to interfere with real aircraft, drones, people, or property.
Gameplay language is fictional/awareness-oriented. Do not treat virtual targets as real-world authority to act against any person or aircraft.
4. Accounts
4.1 Guest
You may play as a Guest. Guest progress is primarily local to your device. Guest mode does not unlock full cloud features.
4.2 Signed-in play
You may sign in with Google and/or Facebook (as offered). You are responsible for your provider account security. We may create a Clear Skies operator account linked to your sign-in.
4.3 Accuracy and security
Provide accurate information where requested. Keep your device and provider accounts secure. You are responsible for activity under your account unless you promptly report unauthorized access.
4.4 Fair use
Do not create accounts to evade bans, manipulate leaderboards, or abuse the Services.
5. License to use the Game
Subject to these Terms, Clear Skies grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Game on devices you own or control for personal, non-commercial entertainment.
You may not:
- copy, modify, reverse engineer, decompile, or create derivative works of the Game except where mandatory law allows;
- cheat, bot, inject, scrape, or interfere with servers or other players;
- remove proprietary notices;
- use the Game to attack Clear Skies systems;
- commercially exploit the Game without our prior written consent.
All rights not expressly granted are reserved by Clear Skies and its licensors.
6. Game and operator data; product improvement
The Services generate and process game data and operator data (for example progress, scores, session and track events, angles, gameplay outcomes, and technical diagnostics).
By playing, you agree that Clear Skies may access, use, store, and analyze this data to operate the Services and to develop, improve, refine, and secure the Game and related Clear Skies products and services, as further described in the Privacy Policy.
Optional research sampling may require a separate in-app preference (default off). Essential service operation and security processing may occur as needed to provide the features you use.
7. Virtual items, progress, and availability
Scores, ranks, unlocks, cosmetics, and other virtual items have no real-world cash value, are licensed (not sold) as part of the Game, and may be modified, reset, or removed as we update the Game. We do not guarantee uninterrupted availability. Maintenance, outages, or discontinuation may occur.
If paid content is offered later, additional store terms (including Google Play) will apply; refunds follow the store’s rules unless required otherwise by law.
8. Outdoor AR safety and real-world conduct
You agree to:
- stay aware of traffic, terrain, people, property, and airspace;
- obey all laws, posted rules, and lawful instructions;
- avoid trespassing and unsafe locations;
- not use the Game while driving or operating machinery;
- not harass others or create public disturbance;
- not use the Game to plan or commit any crime or harmful act.
You use the Game outdoors at your own risk. AR can distract you. Clear Skies is not responsible for real-world injury, property damage, fines, or disputes arising from how you play.
9. User content and feedback
If you send feedback, ideas, or support materials, you grant Clear Skies a worldwide, royalty-free license to use them to operate and improve the Services without obligation to you, to the extent permitted by law. Do not send confidential third-party information.
10. Acceptable use
You will not:
- break the law or infringe others’ rights;
- upload malware or attempt unauthorized access;
- probe or overload our systems beyond normal play;
- impersonate others or misrepresent affiliation;
- use automated means to farm progress without permission;
- misuse sign-in, age gates, or deletion flows.
We may suspend or terminate access for violations.
11. Third-party services
The Game may depend on third parties (device OS, Google Play, Google/Facebook sign-in, Firebase, hosting providers, weather APIs). Their terms and privacy policies apply to their services. We are not responsible for third-party outages or policy changes beyond our reasonable control.
11.1 Third-party audio attribution
“Air Raid Siren” by Orange Free Sounds / alexander, source recording, licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). The Game uses a mono PCM copy with level, filtering, periodic gating, and mission-envelope processing.
12. Privacy
Our Privacy Policy explains how we handle personal information. It is incorporated by reference.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR SKIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT VIRTUAL CONTENT WILL MATCH REAL-WORLD CONDITIONS.
AR tracking, compass/GPS accuracy, weather inputs, and device performance vary. Virtual drones are not real aircraft.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR SKIES AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE GAME IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 50 (or local currency equivalent).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
15. Indemnity
To the extent permitted by law, you will defend and indemnify Clear Skies against claims arising from your misuse of the Services, your violation of these Terms, or your real-world conduct while playing.
16. Suspension and termination
You may stop using the Game at any time and may delete your account as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Services. Provisions that should survive will survive termination.
17. Changes
We may update the Game and these Terms. Material Terms changes will be posted with a new date and, where appropriate, notified in-app or on our website. Continued use after the effective date constitutes acceptance, except where mandatory law requires otherwise.
18. App stores
If you download the Game from Google Play, you also comply with Google Play’s terms. Google is not responsible for the Game or these Terms. In the event of conflict about store billing, the store’s rules for payments and refunds control for those transactions.
19. Governing law and disputes
These Terms are governed by the laws applicable to Clear Skies’ principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country give you a right to local courts or alternative dispute resolution. Specific venue language may be updated after counsel review.
20. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement for the Services.
- Severability. If a clause is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms; we may assign them in connection with a reorganization or transfer of the Game.
- Language. English controls if translations differ, except where mandatory law says otherwise.
